The lawsuits against Fortnite will have intimidated Microsoft, who used the same dances in the racing game Forza Horizon 4, which the company removed from the game.
Epic Games, the producer of Fortnite, has been grappling with dance cases lately. Actor Alfonso Ribeiro, Instagram phenomenon The Backpack Kid, rapper 2 Milly and the mother of the boy known as ‘The Boy in the Orange Shirt’.
Weeks after the trials surfaced, the Floss dances of Carlton and the Instagram phenomenon The Backpack Kid, the subject of a lawsuit filed by actor Ribeiro, were removed from Forza Horizon 4. Forza Horizon 4 is a racing game with its structure but sometimes we can see drivers celebrating and dancing.
Among the reasons for the charges against Fortnite are “misreflection of the capabilities of African-American minorities”, and the most interesting case against the company is the lawsuit filed by the mother of the Orange Tishtboy. Because it’s already a dance for a Fortnite competition.
Experts are sceptical about whether dances can be sued, but it doesn’t stop them from suing in succession. Nevertheless, the dances continue to take part in the game.
